Welcome to POI Circle ("the Service," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website located at poicircle.com and any related services. By accessing or using POI Circle, you agree to these Terms and all policies referenced herein. Please read these Terms carefully.

1. Subscription to the Service

POI Circle offers access to its database and search tools on a subscription basis. By purchasing a subscription, you are granted access to the features and data specified for your chosen plan for the duration of your subscription term. Subscription plans, their features, and pricing are listed on our Pricing page.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during the registration process and to keep such information up to date.

2. Refund Policy

We strive for your satisfaction, but all subscription fees are generally non-refundable. Exceptions may be made at our sole discretion if you experience technical issues that prevent use of the service and notify us promptly. Refund requests must be made in writing within 7 days of your original purchase date. To request a refund, contact support@poicircle.com.

No refunds will be issued for partially used subscription periods, unused data credits, or downgrades.

3. Fee Changes

POI Circle reserves the right to change its fees for subscription plans at any time. Any fee changes will be announced in advance on our website or via email. New fees will apply to new subscriptions or upon renewal of your current subscription. Continued use of the Service after fee changes constitutes your acceptance of the new fees.

4. Free Trial

We may, at our sole discretion, offer a free trial period for new users. The duration and features of any free trial will be specified at sign-up. You may be required to enter billing information to access the free trial. At the end of the free trial, your subscription will automatically convert to a paid plan unless you cancel prior to the trial’s end. Each user is limited to one free trial, and abuse of this policy may result in account suspension.

5. Intellectual Property

All content, features, and functionality on POI Circle—including but not limited to text, graphics, logos, icons, data compilations, and software—are the exclusive property of POI Circle and its licensors. You are granted a limited, non-exclusive license to use the Service for your internal business or personal purposes only. Reproduction, distribution, modification, or republication of any part of the Service without our prior written consent is strictly prohibited.

Any trademarks, service marks, and logos displayed on POI Circle are the property of their respective owners.

6. Links to Other Websites

POI Circle may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites or services. Your use of third-party links is at your own risk.

7. Suspension of the Account

We reserve the right to suspend or terminate your account and access to the Service at any time, without prior notice or liability, for conduct that we believe violates these Terms, is harmful to other users, or to comply with legal requirements. Upon suspension or termination, your right to use the Service will immediately cease, and any unused data credits may be forfeited.

To the fullest extent permitted by law, POI Circle and its affiliates, directors, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of the Service; or (d) any other matter relating to the Service.

9. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We make no warranties, express or implied, regarding the operation, accuracy, reliability, or availability of the Service. We do not guarantee that the Service will be uninterrupted or error-free, or that any data obtained through the Service will be complete or up-to-date. Use the Service at your own risk.

10. United States Legal Compliance

You represent and warrant that (a) you are not located in a country subject to U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country; and (b) you are not listed on any U.S. government list of prohibited or restricted parties. POI Circle is intended for users who are able to form legally binding contracts under applicable law.
